• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES
• PERSONAL INJURY OR PROPERTY DAMAGE OF ANY NATURE RESULTING FROM YOUR ACCESS TO OR USE OF THE SITE OR SERVICES
• UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS OR ANY PERSONAL INFORMATION STORED THEREIN
• INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SITE
• BUGS, VIRUSES, TROJAN HORSES, OR SIMILAR MALICIOUS CODE TRANSMITTED THROUGH OUR SITE BY ANY THIRD PARTY
• ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SITE

IN NO EVENT SHALL PIZZA RANCH'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO PIZZA RANCH IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).

The limitations of this section shall apply to any theory of liability, whether based on warranty, contract, statute, tort (including negligence), or otherwise, and whether or not Pizza Ranch has been informed of the possibility of any such damage. Some jurisdictions do not allow limitations of liability for certain types of damages, so these limitations may not apply to you in their entirety.

9. Indemnification

You agree to defend, indemnify, and hold harmless Pizza Ranch, its parent company, subsidiaries, affiliates, officers, directors, shareholders, employees, contractors, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:

• Your use of or access to the Site or Services
• Your violation of these Terms or any applicable law or regulation
• Your violation of any rights of a third party, including intellectual property rights, privacy rights, or publicity rights

11. Dispute Resolution and Arbitration

11.1 Informal Resolution

We will attempt in good faith to resolve your concern within thirty (30) days of receiving written notice. If we are unable to resolve the matter informally within that time frame, either party may pursue the formal dispute resolution process described below.

11.2 Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Except as provided below, you and Pizza Ranch agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Site and Services shall be resolved by binding arbitration, rather than in court. This arbitration agreement is governed by the Federal Arbitration Act (9 U.S.C. § 1 et seq.) and shall be administered by a recognized arbitration organization under its then-current rules.

The arbitration shall take place in the United States at a location mutually agreed upon by the parties, or via remote/virtual proceedings where appropriate. The arbitrator shall have the authority to award any remedy that a court of competent jurisdiction could award. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

11.3 Class Action Waiver

YOU AND PIZZA RANCH AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING. If this class action waiver is found to be unenforceable, then the entire arbitration provision shall be null and void.

11.4 Exceptions to Arbitration

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened misappropriation of intellectual property rights or unauthorized disclosure of confidential information. Additionally, claims that qualify for small claims court may be brought in that venue.

12. Term and Termination

These Terms shall remain in full force and effect for as long as you use the Site or Services or maintain an account with Pizza Ranch. We reserve the right, in our sole and absolute discretion, to terminate or suspend your access to all or any part of the Site or Services at any time, with or without notice, for any reason, including but not limited to:
